Court Marriage Advocate Amjad Khan and Special Marriage Lawyer
Under Muslim Personal Law (Shariat), solemnizing a Nikah on the same day is completely legal and valid.
Once the Qazi is fully satisfied with the verification of all mandatory legal documents, age proofs, and witness credentials, the Nikah ceremony is solemnized on the same day, and an official primary legal proof—the Nikahnama—is issued immediately.
Before solemnizing the Nikah, the Qazi verifies the following statutory conditions and documents:
Requirement
Statutory Standard
Minimum Age (Groom)
Must be at least 21 years completed.
Minimum Age (Bride)
Must be at least 18 years completed.
Identity & Age Proof
Valid Government ID (Aadhaar Card, Voter ID, Passport, or Birth Certificate).
Witnesses
Minimum of 3 Adult Witnesses possessing valid Government ID Proofs (Aadhaar/Voter ID).
Documents & Age Verification: The Qazi inspects government identity records (such as Aadhaar Card or Passport) for both the groom and bride to verify that both parties meet the legal marriage age requirements (21+ for the groom, 18+ for the bride) and are legally eligible to marry.
Three (3) adult witnesses must be present on site with their valid government ID proofs, in whose presence the Nikah ceremony is conducted.
The Qazi conducts the ceremony by obtaining the free consent (Ijab-o-Qubool) of both parties and fixing the Mahr amount as per Islamic law.
Upon completion of the ceremony, the Qazi issues an official Nikahnama on the same day, bearing the signatures of the groom, bride, 3 witnesses, and the Qazi. This document serves as primary legal proof of the marriage.
While you can legally perform a Same-Day Nikah in Delhi, obtaining a Same-Day Government Marriage Registration Certificate is not possible due to two main reasons:
The Delhi Government processes Muslim marriage registrations primarily under the Special Marriage Act, 1954 (via the e-District portal). Under this statute, the SDM office is legally required to issue a 30-day public notice before registering the marriage. This statutory waiting period cannot be bypassed.
Although the Delhi High Court has observed that personal law marriages should have a simplified compulsory registration process, the current Delhi Government portal and SDM offices still route applications through the 30-day notice procedure.
The Nikahnama issued by the Qazi is available on the same day, but obtaining the official SDM Court Marriage Certificate requires a mandatory 30-day waiting period.
